ARTICLE 1: The Promoter, Hertz Europe Limited | 11 Vine Street, Uxbridge, UB8 1QE, United Kingdom, organised from 07/08/2020 to 10/09/2020 a Facebook and Instagram competition called: "#HertzEURoadTrip”

ARTICLE 2: This competition is free to enter and no purchase is necessary. It will be active from 07/08/2020 00:00:01 am Greenwich Mean Time (“GMT”) - 10/09/2020 11:59:59 pm GMT. To participate in the competition, the individual must be over the age of 21 and hold a valid driver’s licence. The competition is available to residents in the following participating countries: France, Germany, Italy, Netherlands, Spain and United Kingdom. The competition is not open to employees of Hertz, Hertz franchisees, service suppliers, their intermediate subcontractors their families or anyone else professionally connected with this promotion. Only one prize per person is permitted (same name, birthday, and e-mail address).

ARTICLE 3: The competition is intended for use by customers of www.hertz.co.uk and those interacting with either the Hertz Facebook and/or Instagram channel.

ARTICLE 4: You can enter the competition by commenting on a post by the Promoter on Instagram and/or on Facebook. Entrant may enter as many times as they wish on each social media channel. At any time during the competition, the entrant must log onto their respective social media channel and using the hashtag “#HertzEURoadTrip” share what their perfect road trip either was or would be. This may be in the form of a video, photograph and/or written description of the perfect trip that complies with the competition guidelines set out below. Additionally, when applicable as indicated by the post, tagging a friend and sharing your favourite trip in the form of a video, photograph and/or written description of the perfect trip that complies with the competition guidelines set out below is also a viable method of entry. Any replies with indecent content will be reported, deleted and the profile will be blocked. It may also lead to potential prosecution.

Entrant warrants and represents that he/she and any persons appearing or who are identifiable in the photo/video or identified in the text consent to the submission and use of the entry in the competition and to its use as otherwise set forth herein. Entrant will produce evidence of any required consents at the Promoter’s request, or risk being disqualified from entering the competition.

Photo entries must include at least one photo. Video entries must be 30 seconds or less. Text entries must be less than 100 words. In addition, all entries must comply with the following:
- must be entirely the original work of the entrant;
- must not have been submitted previously in a promotion of any kind and has not been exhibited or distributed previously in any media;
- must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, including copyright infringement, or legal or moral rights of any third party, living or deceased (e.g., names, logos, symbols, slogans, photographs that belong to others, photographs of other people, quotes from other people, or parodies of other people);
- must not disparage Hertz or any other third party (e.g., any person, product, location, retailer, company or brand);
- must not in any way contain any names, logos, symbols, slogans, parodies or trademarks of any retailer other than those of Hertz;
- must not include personally-identifiable information;
- must not contain material that is inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious, defamatory, slanderous or libelous, or features gratuitous violence dangerous stunts, real weapons of any kind, illegal drug use, marijuana use (whether legal or not), excessive alcohol use, drunk driving or otherwise promotes unsafe driving;
- must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; - must not contain material that is unlawful, in violation of, or contrary to any laws or regulations; and
- must contain a transparency statement indicating the post was incentivized by the competition (e.g. #contest).

Entrant agrees that the Promoter may, but is not required to, make his/her entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. Entrant agrees to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

ARTICLE 5: There will be one prize for one resident from each participating country, i.e. 6 prizes in total. Each prize consists of 5,600 AnyDay Gold Plus Rewards points valid for use on a one-week Hertz rental, redeemable at participating Hertz locations in UK, Spain, Germany, France, Italy or Netherlands. Rental prize includes mileage allowance, mandatory charges, Collision Damage Waiver (CDW) and Theft Protection (TP ) mandatory insurance with applicable excess, location service charge, vehicle licence fee, taxes, snow chains/tyres where applicable. Rental prize does not include optional extras, excess waivers (SuperCover), personal insurance, child seats, additional drivers, GPS and fuel which are charged at normal rates.If the winner is not a Gold Plus Rewards Member, the winner will need to join Gold Plus Rewards to receive their prize. Joining Gold Plus Rewards is free.

One winner from each participating country with the most interesting entry will be chosen through a panel consisting of Hertz employees and third parties. Each winner will be validated to ensure they have met the terms of the competition – using the correct hashtags. The decision is final and no correspondence will be entered into. The selection will take place no later than three (3) days after the end date of the competition. The winner will be contacted by private message on Facebook or on Instagram. Each winner has 72 hours to claim their prize by replying to the message. If the winner does not respond within the time frame, the prize will be forfeited, and another winner will be selected. The participant is responsible for ensuring their contact details are correct. Hertz will not be liable for any winner notification that is lost, intercepted or not received by a potential winner for any reason.

ARTICLE 6: The prizes are not transferable, exchangeable against another object or against their financial value and can in no way lead to reimbursement of any kind, or any other form of payment, except Hertz reserves the right to substitute for a prize of comparable value. Hertz may in its sole discretion cancel or postpone this competition at any time.

Gold Plus Rewards points have no cash value. Points will expire after 18 months of no rental activity. If you cancel or terminate your Gold Plus Rewards membership, Hertz believes any of your rental activity to be fraudulent, or you are prohibited from future rentals with Hertz, Hertz will remove you and you will forfeit your Gold Plus Rewards balance without any alternate compensation. A prize winner later found ineligible or non-compliant will be immediately required to return and forfeit any prize awarded. Prize redemption is subject to expiration.

ARTICLE 7: Entries will be cancelled if they are illegible, incomplete, counterfeit or made in contravention of the present terms and conditions. Hertz reserves the right to suspend, cancel or amend the competition and/or revise these terms and conditions at any time without giving prior notice, in the event of unforeseen circumstances or circumstances beyond its reasonable control. By continuing to take part in this competition subsequent to any such revision of these terms and conditions entrants shall be deemed to have been agreed to any such new or amended terms.

ARTICLE 8: Hertz is committed to protecting participants’ privacy. Any personal information supplied by participants shall be processed by Hertz or its associated group companies as a data controller in accordance with the Hertz privacy policy for the purposes of administering this competition. Personal data supplied during the course of this competition may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize.

ARTICLE 9: Participation in this competition implies full acceptance of these terms and conditions with no reservation.

ARTICLE 10: Hertz reserves the right to refuse to honour any entry or to recover the full value of the prize if it considers there has been an abuse or breach of the terms and conditions of this competition. Hertz accepts no responsibility for entries not successfully completed due to a technical fault, computer hardware or software failure, satellite, network or server failure of any kind. The decision of Hertz regarding any aspect of this competition is final and binding and no correspondence will be entered into. Hertz shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained under this competition, including but not limited in connection with the prize. However, nothing in these terms shall have the effect of excluding or restricting Hertz’s liability for personal injury or death caused by the proven negligence of its employees or contractors. Your statutory rights are not affected. In the event of a dispute over interpretation or implementation of the rules on any matter related to this competition, the decision of the directors of Hertz is final and no correspondence will be entered into.

ARTICLE 11: This competition will be governed by English Law and entrants to the prize draw submit to the jurisdiction of the English Courts.
