General Rental Terms and Conditions (GTC) - CarVia Rentals
Introduction
The General Terms and Conditions of Rental (GTC) are applicable to all vehicle rental agreements you enter into with CarVia GmbH ("CarVia") for station rentals, including vehicle drop-off from a rental station. Any terms of yours that differ from these GTC will not apply, unless CarVia has expressly agreed to them. Your statutory consumer rights are not affected.
A: Vehicle condition, repairs and operating fluids
- 1. You agree to treat the vehicle with proper care and in the appropriate way, following all applicable rules and technical requirements. This includes regularly checking that coolant and engine oil levels are correct, that the tyres are properly inflated, and that any scheduled maintenance is carried out. You should also check regularly that the vehicle remains roadworthy. Vehicles must always be kept locked, and on convertibles, the roof must stay closed. All vehicles are non-smoking.
- 2. As a rule, the vehicle is provided with a full tank of fuel or a fully charged battery, and it must be returned at the same level. If you return it with less fuel or charge, CarVia will charge you for refuelling or recharging based on the applicable price list or rental agreement. You are entitled to show that no costs were incurred, or that they were lower than charged. If you put in the wrong fuel, you are responsible for all repair costs and any resulting damage.
- 3. For rentals longer than 27 days, you will cover the cost of topping up operating fluids (particularly engine oil, windscreen washer fluid and antifreeze), up to 8% of the applicable monthly net rental fee.
- 4. Repairs and maintenance may only be arranged or carried out with CarVia's prior approval. CarVia can deduct the cost of any damage identified after you return the vehicle from your security deposit. On request, CarVia will provide the relevant repair estimate or invoice.
B: Bookings and credit checks
- 1. If the vehicle is not collected within an hour of the agreed pick-up time, the booking is no longer binding.
- 2. The maximum rental period for an online booking is 27 days. Bookings can be cancelled or rescheduled free of charge up to seven days before the rental period starts. After that, cancellation or rescheduling is possible up to an hour before the rental period starts, subject to a fee of 30% of the original total rental price (including all extras and additional services booked). If the vehicle is not collected within an hour of the agreed pick-up time, the full rental price becomes payable, unless you can show that CarVia incurred no costs, or lower costs.

For risk management and fraud prevention, CarVia may request credit information (for example from SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden) under Article 6(1)(b) and (f) of the GDPR. Further details, including how creditworthiness is assessed, data sources and your rights, are set out in the Privacy Notice, under "Creditworthiness/SCHUFA".
C: Documents, authorised drivers, permitted use and international travel
- 1. When the vehicle is handed over, you must present a valid national driving licence, valid ID, and, if you paid online, the payment method used for the booking. The minimum age and minimum licence holding period depend on the category of vehicle booked. If you do not present the required documents, CarVia is entitled to cancel the rental agreement, and you will have no claim for breach of contract.
- 2. The vehicle may only be driven by you or by the drivers whose names are mentioned in the rental agreement. Additional drivers are only permitted if registered in advance, subject to a fee, and if they present their original driving licence when the vehicle is collected.
- 3. Business customers are responsible for checking that all authorised drivers hold valid driving licences.
- 4. You are responsible for the actions of authorised drivers as if they were your own.
- 5. The vehicle may only be used on public roads and in line with all applicable laws and regulations. Traffic rules must always be followed. In particular, the following are prohibited: carrying passengers for commercial purposes, sub-renting the vehicle, using the vehicle to commit an offence, and transporting highly flammable, toxic or otherwise dangerous substances.
- 6. The vehicle must not be used for motorsport, driving on race circuits (including the "tourist driving" open to the public, such as at the Nürburgring or Hockenheimring), organised sports car tours on public roads, vehicle testing, or safe driving courses. Any of these will void your insurance cover entirely. If you breach this, you will owe a flat penalty of €5,000 to cover the increased risk. CarVia reserves the right to prove a higher loss, just as you can show the actual loss was lower. Unauthorised sub-renting carries a contractual penalty of €2,500.
- 7. There is a strict 0.0‰ blood alcohol limit. Driving under the influence of alcohol or other drugs is strictly prohibited.
- 8. You are responsible for making sure all loads are properly secured.
- 9. International travel is generally not allowed, unless the rental agreement expressly permits it for specific countries. Outside Germany, Austria and Switzerland, extra security measures must be taken, for example using guarded car parks and steering locks. Breaching this can void your insurance cover and lead to claims against you.
- 10. Breaching sections C.2, C.3, C.5, C.6, C.7, C.8 or C.9 entitles CarVia to end the rental agreement immediately or withdraw from it. You will have no claim for compensation arising from that termination or withdrawal. CarVia's right to claim damages is not affected.
D: Rental price, rates and one-way rentals
- 1. If the vehicle is not returned to the pick-up station named in the rental agreement, you will need to cover the cost of bringing it back, or pay a one-way rental fee, unless otherwise agreed in writing.
- 2. The rental price is made up of the base fee, additional services (for example extra mileage, one-way rental, refuelling or charging, service fees and tolls, accessories, delivery and collection) and, where applicable, location-specific surcharges. Applicable rates are set out in the current price list. Special rates and discounts only apply if payment is made on time.
- 3. Delivery and collection services are charged according to the agreed terms.
- 4. For an agreed one-way rental, if the vehicle is returned to a different location than agreed, an additional fee will apply as set out in the relevant agreement.
- 5. Other charges (extract):
- a) Vehicle recovery service: €250.00 plus €2.50 per kilometre
- b) Special cleaning: €179.00, or the actual cost incurred
- c) Lost key: €950.00, or the actual cost incurred, unless you can show the real cost was lower
- Rules on late return or failure to return the vehicle are set out in Section J.6.
E: Due dates, e-invoicing, payment terms, security deposit and termination for non-payment
- 1. The rental price, plus any additional charges and statutory VAT, must be paid in advance, at the latest when the vehicle is collected, for the whole agreed rental period. No refunds are given for late pick-up or early return.
- 2. Invoices are generally issued electronically as a PDF and sent to your registered email address. On request, CarVia will issue a paper invoice. Any reasonable extra costs this involves, for example postage and paper, are charged to you. You are responsible for making sure you can receive electronic communications.
- 3. At the start of the rental period, you must pay a security deposit in the amount stated at booking and in the rental agreement. CarVia is not required to hold the deposit in a separate account, and it does not earn interest. CarVia may also ask for an additional deposit after the rental period has started.
- 4. Unless agreed otherwise, rental costs, additional charges and the security deposit will be charged to the payment method you provided. Charges may be applied up to 12 months after the vehicle is returned, for example for tolls, fines or damage.
- 5. CarVia may place a hold on your credit card, up to its available credit limit, to secure the deposit.
- 6. If you fall behind on payments, CarVia has the right to end the rental agreement immediately. For rentals longer than 27 days, a significant partial non-payment is enough to justify immediate termination.
- 7. If the returned vehicle shows damage that happened during the rental period, you are responsible for covering it. CarVia may offset repair costs against the security deposit.
F: Insurance
- 1. The vehicle is covered by third-party liability insurance of €100 million per claim, capped at €8 million per injured person. This cover applies across Europe, including EU territories.
- 2. Insurance cover does not extend to using the vehicle to transport dangerous goods that require authorisation under Section 7 of the German Ordinance on the Carriage of Dangerous Goods by Road, Rail and Inland Waterway (GefahrgutVStr).
G: Accidents, theft, reporting duties and obligations
- 1. After an accident, theft, fire, damage caused by wildlife, or any other kind of damage, the police must be informed and called to the scene straight away. This applies even to minor incidents or ones you caused yourself, whether or not other people are involved.
- 2. Any damage must be reported to CarVia immediately, both by phone and in writing, and must be properly documented.
- 3. You and any driver must help clarify what happened, answer questions truthfully, and not leave the scene until the essential facts have been gathered, or until CarVia has had the chance to do so.
- 4. CarVia reserves the right to locate vehicles using standard telematics or tracking systems. Further details on the purpose, legal basis, retention periods and your rights are set out in the Privacy Notice.
H: CarVia's liability
- 1. CarVia is liable for intent and gross negligence, as well as for injury to life, body or health. It is also liable for breaches of essential contractual obligations, though in that case only for damage that is foreseeable and typical for this kind of contract.
- 2. CarVia is not liable for items left in the vehicle, except in cases of intent or gross negligence.
I: Your liability
- 1. If the vehicle is damaged or lost, or the contract is breached, you and any driver are liable under the general legal rules. You will not be liable if the breach was not your fault.
- 2. For an extra fee, you can limit how much you must pay for damage, similar to standard collision insurance. The limit does not apply if you caused the damage deliberately. If you were seriously careless, CarVia may reduce the cover depending on how serious your negligence was.
- 3. You are fully responsible for any breaches of traffic law, administrative rules or other legal requirements, and must reimburse CarVia for any related fines or penalties.
- 4. Brake damage, operational wear and pure breakage damage, particularly from shifting loads, do not count as accident damage.
- 5. Tolls must be paid by you, in full and on time. You must also reimburse CarVia for any related claims.
- 6. These rules also apply to authorised drivers. The contractual liability limit does not apply to unauthorised users.
J: Returning the vehicle
- 1. The rental agreement ends when the agreed rental period expires. Section 545 of the German Civil Code (BGB) does not apply.
- 2. The vehicle must be returned at the end of the rental period in the exact condition required by the contract, at the agreed location and time.
- 3. Excessive dirt or persistent odours entitle CarVia to charge for special cleaning.
- 4. Special rates only apply for the agreed rental period. If the period is exceeded or cut short, the standard rate will apply.
- 5. When there is more than one renter, they are jointly and severally liable.
- 6. If you do not return the vehicle or the keys on time, you will need to pay compensation for the extra use.
- 7. Any necessary trips back to the rental station will be charged according to the price list.
- 8. If the vehicle is not returned as agreed, CarVia reserves the right to file a police report and recover the vehicle.
K: Termination
- 1. Both parties can end the contract in line with the law. Where there are multiple rental agreements, CarVia may only end additional ones if you have seriously breached the contract.
- 2. Once the contract ends, the vehicle, documents, accessories and all keys must be returned immediately.
L: Direct debit authorisation
You allow CarVia and its authorised debt collectors to charge your chosen payment method for all rental fees and any other amounts you owe under the rental agreement.
M: Data protection clause
The data controller under data protection law is CarVia GmbH. Your personal data is processed to set up, carry out and end the contract, and to help prevent fraud.
N: General provisions
- 1. You can deduct money CarVia owes you from what you owe CarVia only if CarVia accepts your claim or a court has finally confirmed it.
- 2. The same rights and responsibilities apply to all authorised drivers.
- 3. Where these GTC do not cover something specifically, the German Insurance Contract Act (VVG) and the General Terms and Conditions for Motor Vehicle Insurance (AKB) apply as a fallback.
- 4. The European Commission provides a platform for online dispute resolution.
O: Jurisdiction, written form and contract language
- 1. There are no verbal side agreements.
- 2. The place of jurisdiction is Munich, to the extent permitted by law.
- 3. The contract language is German. Translations are not binding.
- 4. CarVia may update its price lists and these GTC for future contracts.
Right of withdrawal for distance contracts
There is no right of withdrawal for fixed-term motor vehicle rental agreements, under Article 312g(2) No. 9 of the German Civil Code (BGB).
