Procedure Traffic Fines
Hertz submits standard appeals for all traffic fines we receive. We receive these via the CJIB – Centraal Justitieel Incassobureau (Central Judicial Collection Bureau) - and various local authorities. With the information mentioned on the fine, we will find out who the renter was on the date in question.
We send the details of the renter with a notice of objection to the various local authorities or to the CVOM (Central Processing Unit of the Public Prosecution Service).
The CVOM instructs the CJIB to send a new fine to the renter in question. Municipalities handle this themselves. On the fines that are transferred onto the name and address of the renter is a new payment date and new payment reference mentioned, as well as a new objection date. This fine needs to be paid directly to the concerning authority. After our appeal has been declared well-founded, we no longer have any insight into when a new fine will be send to the renter by the relevant authority.
In the exceptional case that our appeal is not accepted, Hertz will send the renter an invoice for this fine.
Attention! Unfortunately, it is no longer possible to switch from renter to driver. In this case the renter is the one paying for the rental. The Mulder Act requires us to provide the details of the renter, even if this is a company and the details of the driver are known. If necessary, the renter (the company) will have to file an appeal and recover the costs from the driver.
In order to make use of article 8 WAHV, the renter must be specified. This should be clear from the rental contract.
1. someone rents a car for himself and at his own expense: this person is then the renter and his name must be mentioned on the rental agreement with the details of the renter,
2. Or someone rents a car on behalf of and on account of a company; this person is then not the renter (at most driver).
The company is a legal entity (usually recognizable by the name of the company by one of the following additions: N.V., B.V., C.V., V.o.f.; for example Shipping Company Ship B.V. or V.o.f. Taxi Central The Journey). In this case, the name of the legal entity must be stated on the rental as renter.
However, in the event of a Strafbeschikking (Notification of Offence) or Kennisgeving (Punitive Order) regarding serious traffic violations, we are obliged to provide the Public Prosecutor's Office (CJIB) with the driver's name and address details, as well as his/her date of birth and telephone number. The renter is obliged to provide us with all the details of the driver so that we can pass these on to the CJIB by means of a reply form.
If the renter is a company, the company itself is responsible for keeping track of the driver(s) of the vehicle.
Procedure Administration costs
We charge a handling fee for searching, checking, sending and storing the traffic fines. These costs are not included in the rental price as this depends on the customer's driving behaviour. According to the rental conditions (art. 14.2) the charging of administration costs is allowed. By using the service of Hertz, the customer agrees to the above conditions.
The administration costs of €32,50 (incl. VAT) will be charged per fine. A separate invoice will be send for this. In case of parking and/or foreign fines, we are sometimes summoned to pay the fine. In that case you will find the amount of the fine as well as the administration costs mentioned on your invoice. On the invoice is a short statement and a reference to our website.

Dutch, Belgian & Luxembourg license plates
If you have received a fine on a Dutch, Belgian or Luxembourg license plate, the renter can look up a copy of the fine himself using the information listed on the invoice of the administration fee at: https://hertz.finesportal.com.
Renters with a fine, driven on a LICENSE PLATE FROM OTHER COUNTRIES, can contact our customer service at customer-relations-ne@hertz.com.
Using the information listed on the administration fee invoice, renters can look up a copy of the fine themselves at: https://hertz.finesportal.com.This copy, which is still in Hertz's name, cannot be used to pay the authorities. The relevant authority will send a new fine in the renter's name and address.
